! 21 of NDPS Act at Police Station Garhi, District Jind "#$#$% & '!() *Petitioner, an accused in case FIR No.148 dated 21.08.2024 registered against him, for commission of offences punishable u/s 21 of NDPS Act (Section 29 of NDPS Act added later on) at Police Station DharamKot, District Moga, has prayed for grant of pre-arrest bail. Learned counsel submits that the petitioner has been falsely implicated in the present case only on the basis of disclosure statement of co-accused Sudesh, who was allegedly caught red handed at the site keeping in his illegal possession 14.24 grams of Heroin ('Intermediate Quantity'). Learned counsel further submits that said disclosure statement, in the absence of recovery of any other incriminating material, is not admissible in evidence. Learned counsel next submits that petitioner has been falsely implicated in 2 other cases also. Learned counsel further submits that petitioner is willing to join the investigation as and when called for by the IO.
Status report by way of an affidavit of Mr. Kamaldeep Rana, Deputy Superintendent of Police, Narwana, District Jind has been filed today in Court.

In view of the submissions advanced by learned counsel for the petitioner, but without further adverting to the merits of the case, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).
