However, at this stage, counsel for the respondent submits that the respondent intends to withdraw the petition under Section 9 of Hindu Marriage Act, which is sought to be transferred, at the instance of the applicant. On query by the court, he gives an undertaking that the respondent shall withdraw the petition under Section 9 of Hindu Marriage Act i.e. HMA-904-2024 titled 'Gaurav Kumar v/s Alka Saini', on the next date fixed, before learned Trial Court.

In view of the undertaking, so given, by the counsel for the respondent, at this stage, counsel for the applicant submits that he does not want to pursue with the present application and the same be dismissed as withdrawn.

Ordered accordingly.

However, the respondent shall remain bound by the statement, so given by his counsel today.
