Prayer in the present petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS'), is for grant of anticipatory bail to the petitioner, in case FIR No.201 dated 21.11.2025, under Sections 74 and 351(2) of BNS, registered at Police Station Dugri, District Police Commissionerate, Ludhiana.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present FIR, which even otherwise was registered after a delay of 81 days. It is submitted that the parties were in fact well known to each other, however, due to certain differences, the instant FIR was registered against the petitioner by levelling sweeping and baseless allegations of harassment. It is submitted that there is no material on record to substantiate the allegations levelled against the petitioner. Moreover, despite the alleged incident having occurred at a public place, no

-2independent witness has come forward to corroborate the version of the complainant.

Vide order dated 12.03.2026, the petitioner was directed to join investigation. The said order is reproduced hereinafter:- "In pursuance of the order dated 13.02.2026, respondent No.3 has been duly served through WhatsApp. However, despite service, there is no representation on behalf of respondent No.3. A perusal of the order sheet demonstrates that the petitioner has not been directed to join the investigation. Accordingly, the petitioner is directed to join the investigation on 18.03.2026 at 10:00 A.M. before the Investigating Officer and to cooperate with the Investigating Agency thereafter.

Interim order to continue.

Adjourned to 27.03.2026."

Learned State counsel on instructions from ASI Balwinder Singh, submits that in compliance of order dated 12.03.2026, the petitioner has joined the investigation on 18.03.2026 and is not required for any further investigation.

Having considered the aforesaid facts and circumstances, the petition is allowed. Order dated 12.03.2026 passed by this Court, is hereby made absolute, subject to the condition enumerated under Section 482(2) BNSS.

This order should not be treated as "blanket" order. It will not be read as granting the petitioner(s) indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 7.

Liberty is reserved with the investigating agency/complainant to move to this Court for a direction under Section 483(3) of BNSS, 2023 (erstwhile Section 439(2) of Cr.P.C.), in the event of violation of any term, stipulated under Section 482(2) BNSS, or upon showing any other sufficient

-3cause. The petitioner shall not make any attempts to re-associate with the prosecutrix or her family members in any manner either through a device or in-person.

Pending miscellaneous application(s), if any, also stands disposed of.
