For committing the offence under section 420 IPC, both the Courts below have convicted and sentenced the petitioner and dissatisfied with the same, present revision petition has been filed by the petitioner. 2.
After hearing the submissions addressed by counsel for the petitioner, on 13.01.2026, following order was passed:- "i) Present revision has been filed against the impugned judgment dated 20.11.2025 passed by learned Additional Sessions Judge, Fatehabad, whereby learned Additional Sessions Judge dismissed the criminal appeal filed by the petitioner and upheld the conviction and sentence passed by learned SDJM, Ratia. Learned SDJM, Ratia convicted petitioner for the offence under Section 420 IPC in a complaint case and sentenced him to undergo rigorous imprisonment for a period of two years along with a fine of Rs.5,000, vide judgment dated 17.12.2018 and order dated 18.12.2018.
ii) Learned counsel for the petitioner submits that at the time of dismissal of the appeal, petitioner was not present in Court. Therefore, matter is adjourned to 05.02.2026 to enable the petitioner to first surrender before the concerned Court or the Jail Authorities." On 05.02.2026, neither there was any representation on behalf of the petitioner, nor any report was received regarding the petitioner's surrender, as had been directed in the previous order dated 13.01.2026.

Even today, there is no representation on behalf of the petitioner. Therefore, this Court is left with no other option but to dismiss the present petition for want of prosecution. 5.
Accordingly, present petition stands dismissed for nonprosecution. 6.
However, in case, petitioner surrenders before the concerned jail authorities, it shall be open for him to move an appropriate application for recalling of today's order and to seek revival of the present petition.

Pending miscellaneous application(s), if any, shall also stand disposed of.
