CM-5774-CWP-2026 Prayer in the present application is for placing on record the permanent address of respondent No.7, copy of action taken report dated 19.12.2025 (Annexure P-18), copies of complaints dated 18.12.2025 and 13.03.2026 alongwith photographs (Annexure P-19), copy of reply of legal notice dated 19.01.2026 (Annexure P-20), copy of RTI Reply dated 02.01.2026, 02.03.2026, 17.03.2026 and also RTI Application dated 25.02.2026 (Annexure P-21) as well as copy of Replication/Rejoinder and copy of amended memo of parties alongwith other annexures as mentioned in the Index.

For the reasons mentioned in the application, the aforesaid documents, are taken on record, subject to all just exceptions. Application is accordingly disposed of.

CWP-38274-2025 At the oral request made by learned counsel for the parties, the present matter is preponed from 23.07.2026 to today itself and taken on Board for hearing.

Petition herein is, inter alia, seeking a writ in the nature of Mandamus for directing respondents No.1 to 4 to immediately stop and stay

and demolish the illegal and unauthorized construction being raised by respondent No. 7 in the plot adjacent to the plot of the petitioner. 3.

A perusal of the order sheet reveals that notice of motion has already been issued and the matter stands adjourned to 23.07.2026. Now an application i.e.

CM-5773-CWP-2026 has been filed by the applicant/petitioner for impleading respondent No.8 in the present matter, which was allowed today only.

Today, Mr. Nitin Jain, Advocate appears and files Vakalatnama on behalf of respondent No.7 in Court today, which is taken on record subject to all just exceptions. He, at the outset, submits that the plot in question is owned and used by respondents No.7 and 8 and as on date, only a boundary wall has been raised around the plot and one temporary room has been constructed with a tin shed. In this regard, he has produced photographs of the site in question; which are taken on record subject to all just exceptions. A copy thereof has been handed over to learned counsel for the petitioner in Court today and he has not disputed the status of site, as depicted from the photographs.

4.1 Learned counsel for respondents No.7 and 8 submits that they would not raise any Pakka construction at the site, without first getting the necessary permission/approval from the concerned/competent authority (including the sanctioned layout plans/building plans). 5.

Keeping in view the aforesaid statement made by learned counsel for respondent No.7, learned counsel for the petitioner submits that he does want to press the present petition any further and the same be disposed of accordingly.
