This petition has been filed under Section 528 of the BNSS, 2023 for issuance of directions to respondent No. 1 as well as respondent Nos. 2 and 3 to take appropriate legal and departmental action against the police officials for violating the fundamental rights of the petitioner as envisaged under Article 21 of the Constitution of India and to protect the life and liberty of the petitioner and prevent unnecessary harassment of the petitioner from the hands of the respondents. 2.
Learned counsel for the petitioner submits that the police interference arises solely on account of criminal allegations against the petitioner's son. She further submits that the petitioner has lawfully disowned and dispossessed his son from all his movable and immovable properties, and a public notice to this effect was duly published in a widely circulated newspaper. CRM-M-72878-2025 officials are repeatedly visiting the petitioner's residence and allegedly threatening him in connection with the activities of his son. 3.
Notice of motion.

Mr. Rishabh Singla, AAG, Punjab accepts notice on behalf of the respondent and submits that investigation shall be carried out as per law.

I have heard learned counsel for the parties and perused the record.

Keeping in view the above and the assurance given by the learned State counsel, this Court finds no ground to interfere with the investigation being carried out by the Investigating Agency. However, the official respondents are directed to issue a formal notice in writing at least three days in advance to the petitioner, in case the petitioner is required for investigation.
