(Oral) The e instant petition has been file ed under Section 482 of the Bharatiya Nagar rik Suraksha Sanhita, 2023 for grant of anticipatory bail to the petitioner in n case bearing FIR No.142 dated 12.08.2025 registered under Sections 329(3) [Section 305 BNS was added later on and Section 329(3) BNS w was deleted vide GD No.021 dated 03.12.2025] of the Bharatiya Nyay ya Sanhita, 2023 at Police Stat tion Division No.2, District Pathankot.

Lea arned counsel for the petitione ers, inter alia, contends that pursuant to the order dated 23.12.2025 passed b by this Court, the petitioners have joined the investigation and are no longer required for the purposes of investigation. It is further submitted that the ma atter was also referred to the Mediation and Conciliation Centre of this Co ourt vide same order dated 23.12.2025, and d the parties were directed to o appear before the learned Mediator on 1 7.01.2026. The parties accord dingly appeared before the Mediator on the e said date and have amicably r resolved their dispute vide a SUMIT SINGH GUSAIN 2026.03.18 18:17 I attest to the accuracy and integrity of this document

A mediation report submitted by Mr. Dhanpat Rai Singla, learned Mediator, has been received and perused. The Settlement Agreement arrived at between the parties is also annexed to the said report. 4.

Learned State counsel on instructions, corroborates the said averment and submits that the custodial interrogation of the petitioners is not required for the purpose of investigation.

Heard learned counsel for the parties.

Since the parties have settled their dispute and further the petitioners have joined the investigation and their custodial interrogation is not required, the present petition is allowed and the interim order dated 23.12.2025 is made absolute.

However, the parties shall remain bound by the terms and conditions contained in the Settlement Agreement dated 06.02.2026, arrived at before the Mediation and Conciliation Centre of this Court. 7.

The petitioners shall, however, continue to join investigation as and when required to do so and shall abide by the terms and conditions, as laid down under Section 482 (2) BNSS.
