Prayer in the present petition is for seeking quashing of FIR No.206 dated 12.12.2023, under Section(s) 447, 427, 506, 511, 452, 148 and 149 IPC registered at Police Station Garhshankar, District Hoshiarpur along with all the subsequent proceedings arising therefrom. 2.

Short reply by Daljit Singh, PPS, Deputy Superintendent of Police, Sub Division Garhshankar, District Hoshiarpur already filed on behalf of the respondent-State, is taken on record. 3.

Mr. Aditya Sharma, Advocate for Mr. Parvinder Singh, Advocate has filed memo of appearance on behalf of respondent No.2 in Court today, which is taken on record.

Learned counsel for respondent No.2 as well as respondentState contend that upon completion of investigation, the Police has filed a cancellation report before the trial Court. However, being dissatisfied with MONIKA VERMA 2026.06.01 12:08 I attest to the accuracy and authenticity of this order/judgment chandigarh

CRM-M-72680-2025 (O&M) -2the conclusions arrived at by the police, the complainant-respondent No.2 had preferred a protest petition against the aforesaid cancellation report. Upon consideration of the material placed on record, the Sub Divisional Judicial Magistrate, Garhshankar, vide order dated 28.04.2026, proceeded to take cognizance of the impugned FIR and upon finding sufficient grounds to examine the allegations further, directed production of all the complainant witnesses.

I am of the opinion that the matter is presently at nascent stage before the Magistrate and the proceedings are presently pending consideration before the competent Court and any interference at this stage would be premature and unwarranted.

In the given circumstances, the present petition is disposed of at this stage with liberty to the petitioner to raise all the pleas before the Illaqa Magistrate at appropriate stage under Section 223(1) BNSS, if so advised. 26.05.2026 (VINOD S.
