The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, <BNSS=) seeking issuance of directions to respondents No. 2 to 5 to decide the representation dated 13.12.2025 moved by the petitioners, praying that they not be harassed or falsely implicated in any criminal case on the basis of the complaint made by respondents No. 6 to 8, as the petitioners are the real sisters and mother of Naveen Kumar, the husband of respondent No. 6, who is an NRI residing in Australia since 2015, and is stated to have solemnized a second marriage with respondent No. 6, with matrimonial disputes presently subsisting between them.

Learned counsel for the petitioners submits that the petitioners, being married sisters living separately, have no role or participation in the matrimonial relationship between Naveen Kumar and respondent No. 6, and they apprehend being implicated solely on account of their relationship with Naveen Kumar.

Mr. Rishabh Singla, AAG, Punjab accepts notice on behalf of the official respondent and submits that investigation shall be carried out as per law.

I have heard learned counsel for the parties and perused the record.

Keeping in view the above and the assurance given by the learned State counsel, this Court finds no ground to interfere with the investigation being carried out by the Investigating Agency. However, the official respondents are directed to issue a formal notice in writing at least three days in advance to the petitioners, in case the petitioners are required for investigation. 7.
