 :#!    31   .5:/5:%/% "; * ' "earned counsel for the petitioner submits that taken the allegations levelled in the FIR to be correct, the petitioner and the deceased alongwith co-accused of the petitioner namely, Davinder and Neeraj all were drug addicts. The deceased had died on account of an overdose and there was



no intention on the part of the accused persons to cause death of the deceased. As the petitioner is in custody since 13.09.2025 but only 02 out of 23 prosecution witnesses have been examined so far, ' "    ""9% "9   "

A reply dated 04.04.2026 by way of an affidavit of Hemant Malhotra, PPS, Deputy Superintendent of Police, Sub Division Balachaur, SBS Nagar has been filed on behalf of the State by the learned counsel for the State. The same is taken on record. He along with the learned counsel for the complainant, on the other hand, contend that the allegations against the petitioner and his co-accused are grave. They had consumed drugs and because of overdose of the same, the deceased passed away. They further submit that one of the accused persons namely Neeraj is absconding and has not been arrested till date. Therefore, the petitioner is not entitled to the concession of regular bail. They, however, concede that the petitioner is in custody since 13.09.2025 and out of 23 prosecution witnesses, only 02 have been examined till date.
