The present petition has been filed under Section 482 BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.0130, dated 28.10.2025, under Sections 21, 61, 85 of NDPS Act (Section 29 of NDPS Act added later on), registered at Police Station Mehta, District Amritsar Rural. 2.
On 23.12.2025, the Co-ordinate Bench had passed the following order:- "The present petition has been filed under Section 482 of the BNSS, 2023 for grant of pre-arrest bail to the petitioner in case bearing FIR No.0130 dated 28.10.2025, under Section 21 of the NDPS Act (offence under Section 29 of the NDPS Act added later on) registered at Police Station Mehta, District Amritsar Rural. Learned counsel appearing on behalf of the petitioner inter alia contends that recovery of 45 grams of Heroin had been effected from coaccused Ranjodh Singh which is an intermediate quantity. The petitioner was nominated as an accused on the disclosure of the said co-accused. He contends that there is no link which establishes that the petitioner is involved nor any recovery has been effected from the petitioner pursuant to such disclosure. He further submits that the petitioner is not involved in any other case under the NDPS Act and he is ready and willing to join the investigation as and when required to do so.

To come up on 11.03.2026, for further consideration. In the meantime, the petitioner is directed to join investigation as and when required by the Investigating Agency. Learned counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, he shall make himself available without demur.

Learned State counsel on instructions from ASI Palwinder affirms the factum of joining the investigation by the petitioner and cooperating with the investigating agency. She also submits that at this stage, the petitioner is not required for further custodial interrogation. 5.
In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 23.12.2025 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
