This petition has been filed under Section 528 of BNSS for quashing the order dated 27.09.2022 and non-bailable warrants order dated 08.05.2025 issued by ld. Civil Judge (JD)-cum-JMIC, Gurugram Haryana in case No. NACT-392/2022 titled as "Abudance India Vs. Suniraat Overseas Pvt. Ltd" against the petitioners.

Learned counsel for the petitioner submits that the petitioner could not appear before the learned trial Court on the ground that Indo-Pak war tension is going on in whole India and also mock drill is applicable in the district of petitioner and for his non-appearance, exemption application was filed and the same was dismissed vide order 08.05.2025 and non-bailable warrants issued against the petitioner. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned RENU RAWAT 2026.02.19 14.56 I attest to the accuracy and integrity of this document Chandigarh

This Court deems it appropriate to decide this case without issuing notice to the respondent.

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere with the impugned orders passed by ld. Civil Judge (JD)-cum-JMIC, Gurugram Haryana. However, the petitioner is directed to surrender before the trial Court within a period of 07 days at 10:00 A.M from today and moves an application for grant of regular bail, the trial Court is directed to consider and decide the application on the same day.
