***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, the respondent did not make appearance, on that date. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/1189/2023, titled 'Sandeep v/s Ritu, filed by the respondent-husband, pending in the Family Court, Hisar and she seeks transfer of the same to the Court of competent jurisdiction at Jind.

Counsel for the applicant heard.

At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 29.11.2012 and three children, two daughters and one son were born from the said wedlock, who in the age group of 7-12 years. TA-1725-2025 in the care and custody of the applicant. The applicant is not having any source of earning. Even, the respondent had filed petition under Section 25 of Guardian and Wards Act i.e. GW/24/2025, which is pending in the courts at Jind. The distance between the two places is stated to be 92 kms.

Considering the submissions aforesaid, more particularly, about the applicant taking care of the three minor children, while herself having no source of earning as well as the fact of one another litigation filed by the applicant and one litigation filed at the instance of the respondent, arising from this estranged marriage to be already pending in the Courts at Jind, and above it, considering the fact of respondent not having come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/1189/2023, titled 'Sandeep v/s Ritu, filed by the respondent-husband, stands transferred from the Family Court, Hisar, to the Court of competent jurisdiction at Jind.

The requisite record of the aforesaid case be sent by the Family Court, Hisar, to the District and Sessions Judge, Jind.

Learned District and Sessions Judge, Jind, shall assign the said petition to the Family Court, Jind. Even, the parties are directed to appear before the Family Court, Jind, within a period of one month from today onwards.
