(Oral) Petition herein is, filed under Article 226/227 of the Constitution of India, inter alia, seeking a writ in the nature of Certiorari, for setting aside the order dated 01.11.2025 (Annexure P-8) passed by Chief Regional Manager (Retail), Hindustan Petroleum Corporation Limited (respondent No.4), whereby the representation of the petitioner for allotment of retail outlet has been rejected.

The operative part of the order dated 01.11.2025 (Annexure P-8), reads as under:- "The points raised in your letter dated 06.11.2024 have been carefully examined, and the following facts and observations are provided for your information and consideration: (a) Letter of Intent dated 30.11.2023 was issued on the name of Sh. Naresh Aggarwal for advertised location "ON ROAD CONNECTING RAMSWAROOP CHOWK

CWP-39513-2025 (O&M) -2TO KABRI ROAD, WITHIN MUNICIPAL LIMIT OF PANIPAT CITY", District PANIPAT, State HARYANA, as per Dealer Selection Guidelines.

(b) In line with guidelines, District Magistrate NOC was applied for establishment of Retail Outlet at proposed location. District Magistrate office had sought NOC from various departments for the purpose.

(c) LOI holder, Sh. Naresh Aggarwal has informed that No objection/permission from ten (10) different departments is obtained. Also, application for CLU is pending before Urban Local Bodies, Haryana state. (d) From your letter dated 06.11.2024, it is noted that you have not submitted any document establishing that MC, Panipat and/or ULB department has rejected the CLU application. Same was also enquired during meeting dated 27.10.2025. However, you had stated that you are not having any such document establishing that Municipal Corporation, Panipat had rejected the NOC or permission regarding CLU application by LOI holder, Sh. Naresh Aggarwal.

From the available records, it is evident that the NOC/permission process related to the LOI issued in the name of Sh. Naresh Aggarwal is underway and has not been rejected by any department to date. Since, there is pending LOI, your application for the subject-advertised location can not be considered at this stage. Any action regarding the location "ON ROAD CONNECTING RAMSWAROOP CHOWK TO KABRI ROAD, WITHIN MUNICIPAL LIMIT OF PANIPAT CITY", District PANIPAT, State HARYANA under OPEN category Advertised on 28-06-2023 and pending LOI, shall be taken in line with Corporation's policy and dealer selection guidelines." 3.

At this stage, Ms. Upasana Dhawan, AAG, Haryana, who is present in Court is directed to seek instructions as regards the status of the

CWP-39513-2025 (O&M) -3application for grant of CLU, which is stated to be pending before the Director General Urban Local Bodies (Haryana). 3.1 She, on instructions from Mr. Subhash Saini, ADA, o/o Director Urban Local Bodies, Panchkula and Mr. Bijender Singh, Assistant, D.C. office, Panipat informs the Court that certain documents have been requisitioned from the respondent No.5 and the application for grant of CLU is pending consideration before the Director General, Urban Local Bodies (Haryana) and that the final decision shall be taken thereon within a period of 1 month from today.

Keeping in view the aforesaid stand taken by the learned State counsel, no further order is required to be passed and the present writ petition stands disposed of, accordingly.

Any further action in the matter shall be taken by the concerned authorities strictly in accordance with the decision taken by the Director General, Urban Local Bodies (Haryana) on the application for grant of CLU submitted by respondent No.5. It is further directed that the decision taken by the Director General, Urban Local Bodies (Haryana), shall also be communicated to the petitioner.
