Prayer in the present petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS'), is for grant of anticipatory bail to the petitioner, in case FIR No. 0105 dated 30.10.2025, under Section 69 of BNS, 2023, registered at Police Station Behrampur, District Gurdaspur.

Vide order dated 24.12.2025, the petitioner was directed to join investigation. The said order is reproduced hereinafter:- "x x x x x Brief facts of the case are that petitioner and the complainant were engaged, and their marriage was fixed for 07.11.2025. However, during period between the engagement and the scheduled date of marriage, certain disharmony occurred between the parties which ultimately led to lodging of the present FIR. Issue notice of motion.

Mr. Japjot Singh, AAG, Punjab accepts notice on behalf of respondent-State.

-2At the very outset, Mr. Gobind Singh Randhawa has put in appearance on behalf of the complainant/respondent no.2 and has filed his memorandum of appearance. Learned counsel seeks some time to file vakalatnama on her behalf.

Learned counsel for both the parties are ad idem that effort can be made to amicably resolve the dispute at this stage only. In light of the above, the parties are directed to appear before the Mediation and Conciliation Centre of this Court on 19.01.2026 for exploring the possibility of an amicable settlement. The petitioner is directed to join the investigation on 03.01.2026 at 11 A.M . before the Investigating Officer and to cooperate with the Investigating Agency thereafter. In the event of arrest, the petitioner shall be released on interim bail, subject to furnishing personal/surety bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the conditions envisaged under Section 482, BNSS, 2023.

Adjourned to 23.02.2026.

It is made clear that this order shall not be construed as parity qua any other co-accused."

As per the report dated 28.1.2026 received from the Mediator, the matter could not be amicably settled between the parties. 4.

Learned State counsel on instructions from ASI Ramesh Lal, submits that in compliance of order dated 24.12.2025, the petitioner has joined the investigation and is not required for any further investigation. 5.

Having considered the aforesaid facts and circumstances, the petition is allowed. Order dated 24.12.2025 passed by this Court, is hereby made absolute.

This order should not be treated as "blanket" order. It will not be read granting the petitioner(s) indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.

This order does not in any manner limit or restrict the rights or duties of the police or investigating agency to investigate into the charges against the petitioner(s).

The accused-petitioner(s) shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him or her from disclosing such facts to the Court or to any police officer.

The accused-petitioner(s) shall not leave India without prior permission of the Court.

The accused-petitioner(s) shall join the investigation as and when called by the police.

It will be open to the police or the investigating agency to move to this Court for a direction under Section 483(3) of BNSS, 2023 (erstwhile Section 439(2) of Cr.P.C.) to arrest the accused-petitioner(s), in the event of violation of any term, such as absconding, non-cooperating during investigation, evasion, intimidation or inducement to witnesses with a view to influence outcome of the investigation or trial. 12.

Pending miscellaneous application(s), if any, also stands disposed of.
