Present Criminal Writ Petition has been filed by petitioners, Baldev Singh, aged 68 years and Lovedeep Singh, aged 29 years, has been filed by the petitioners for issuing directions to respondent No.2 to protect the lives and liberty of the petitioners by deciding representation dated 16.09.2025 (Annexure P-2) submitted by them, but local police is harassing and humiliating the petitioners without any rhyme and reason, and they also want to implicate the petitioners in other FIRs. 2.

Learned counsel for the petitioners argues that earlier, petitioner No.2 was involved in four cases under the NDPS Act, however, in all such cases, he has been acquitted by the concerned Courts. 3.

After hearing learned counsel for the petitioners, on 24.12.2025, following order was passed by this Court:- "1.

Present criminal writ petition has been filed by the petitioners for issuing directions to respondent No.2 to protect the lives and liberty of the petitioners by deciding representation dated 16.09.2025 (Annexure P-2) submitted by them, but local police is harassing the humiliating the petitioners without any rhyme and reason, and also, they want to implicate the petitioners in other FIRs.

It has been alleged that since September 2025, police officials have been raiding the house of petitioner No.1 demanding to handover the custody of his son, namely, Lovedeep Singh @ Deepak @ Deepu (petitioner No.2 herein). In this regard, learned counsel has appended certain photographs and submits that illegal raid conducted by the police officials can be confirmed from the CCTV footage, which is available with the petitioners and has also been appended with present petition as Annexure P-5 in a pen-drive.

State is directed to verify the contents of the petition and thereafter, to submit a detailed and comprehensive status report in the matter.

Let a copy of the complete paper-book be supplied to learned State counsel during course of the day." 4.

Today, learned State counsel has filed the status report dated 21.01.2026 in Court today, which is taken on record. Office to tag the same at appropriate place.

A copy thereof has been handed over to the counsel for the petitioners.

Paragraphs No.4 & 5of the status report reads as under:- "4.

That the deponent humbly submits that as per the report furnished by SHO PS Chheharta, Amritsar, the petitioner No. 2-Lovedeep Singh is a habitual drug peddler being involved in four FIRs i.e. (1) FIR No.165,dated 01.01.2013, under Sections 21,22 NDPS Act, PS Airport, Amritsar (2), FIR No. 211, dated 13.09.2014, under Section 22 NDPS Act, PS Gharinda, Amritsar Rural (3) FIR No. 219,dated 15.10.2018, under Section 22 NDPS Act, PS Chheharta, Amritsar and (4) FIR no. 35, dated 01.05.2019, under Section 21, 25,29 NDPS Act, PS ANTF, SAS Nagar. Therefore, the local police keep surveillance on his activities time to time. 5.

That so far as the averment made in the present writ petition by the petitioner with respect to alleged raid conducted in September 2025 at their house and taking away DVR of their CCTV cameras from their house by police of PS Chheharta, are concerned, it is submitted that the SHO PS Chheharta, Amritsar has further reported that neither any police party from PS Chheharta, Amritsar had conducted raid at the house of the

- 3 - petitioners nor had any one taken DVR etc. from their house. It has been further reported that the petitioner Baldev Singh had given applications bearing No. 2503-ADGP/F dated 17.12.2025 and 2442-ADGP/F, dated 16.12.2025 with respect to causing harassment to his son-petitioner no. 2Lovedeep Singh. During enquiry qua these applications, the petitioner had got recorded his statement that now no one has caused harassment to his son Lovedeep Singh, he is satisfied and the petitioner himself had got closed his applications. Therefore, the above said applications have been filed to office record. The statement of petitioner No. 1-Baldev Singh and enquiry report are annexed herewith as Annexure R-1/T and R-2/T for kind perusal of this Hon ble Court."

After perusing the status report, learned counsel for the petitioners prays for withdrawal of the instant petition with liberty to challenge their alleged false implication by the police with a motivated purpose, before the appropriate forum, in accordance with law. 7.

Dismissed as withdrawn with liberty, as sought and recorded here-above.
