THE HON'BLE MR. JUSTICE S. TALAPATRA 16.01.2018 Heard Mr. SS Debnath, learned counsel appearing for the referring claimant-petitioner as well as Mr. H Deb, learned Asst. SG appearing for the appellant-respondent.

The appeal filed by the Union of India being LA Appeal No. 82/2013 was dismissed by the judgment dated 28.07.2015. Now in terms of the judgment and award dated 12.10.2010 as delivered in Civil Misc.(LA)54/2009, the appellant-respondents have deposited the sum of Rs.16,26,511/-. By means of this petition, the referring claimant has urged this court to allow them to withdraw the said amount.

Mr. Deb, learned Asst. SG has fairly submitted that there is no embargo in disbursing the said amount.

As such, the Registry is directed to transfer the said amount to the Bank account of the petitioner following the due process.

In terms of the above, the instant interlocutory application is allowed and disposed of.
