Chakraborty, learned counsel appearing for the petitioners as well as Mr. D.K. Biswas and Mr. G.K. Nama, learned counsel appearing for the respondents.
A consensus has been arrived between the parties that the joint water supply point shall remain operational in the land on which the water supply connection is set up and the said connection shall remain joint without any disturbance from any other coparceners, but the individual coparcener whose land has been partitioned, shall have the right to take their individual water supply connection from the Agartala Municipal Corporation, despite the fact that there is a joint water supply point. The individual coparcener like the petitioners who would take their individual water supply connection from the Agartala Municipal Corporation, shall not be under obligation to pay any part of the tax or charges for the joint water supply connection. The remaining coparceners shall be under obligation to pay the water charges and the water tax as would time to time be imposed by the Agartala Municipal Corporation.
In view of the decree dated 15.06.2013, if it appears that all the coparceners have taken their individual water supply connection then the joint water supply point shall be discontinued, making necessary information to the Agartala Municipal Corporation. In that event, the coparceners shall be at liberty to determine about the use or disposal of the joint land, on which the water supply point at present is set up. This order shall remain part of the order dated 18.08.2014, passed in CRP No.31/2014. Accordingly, this petition stands disposed of. Download Date: 8-05-2017 15:05 1/1
