Mr. H. Deb, ASG HON'BLE MR. JUSTICE S. TALAPATRA Order 26/04/2018 Heard Mr. DK Biswas, learned counsel appearing vice Mr. SS Debnath, learned counsel appearing for the applicants (the referring claimants) as well as Mr. H. Deb, learned ASG appearing for the respondents.
To satisfy the award, as passed, a sum of Rs. 6,15,152/- has been deposited in the Registry. Now by this petition, the applicants who are the legal heirs of Ramsadhu @ Rammadhu Debbarma have applied for withdrawal of the said sum.
Mr. Biswas, learned counsel has submitted that all the applicants are major and as such there is no legal impediment to receive their respective share out of the total deposited sum. Mr. Deb, learned ASG has submitted that they have no objection if the money is disbursed to the applicants.
In view of this, the Registry is directed on scrutiny the records and on following the process to disburse the amount in equal share to the applicants as early as possible.
In view of this, this application stands allowed and disposed of. JUDGE Saikat
