SAHA The instant application is filed for condoning the delay of 1425 days in preferring the application for restoration of the writ petition being WP(C) 76/2001 which was dismissed for default on 13.12.2010. Heard Mr. Dutta, learned counsel for the applicant as well as Mr. Chakraborty, learned Addl. GA for the State.

This Court has gone through the reasons for delay as explained in the application. It appears from the contentions made in the application that the connected writ petition being WP(C) 76/2001 was dismissed on 13.12.2010 but the petitioner could not contact with his advocate till December, 2014 on expectation that the learned counsel would do the needful and inform the applicant when the case would be matured for final hearing and would participate in hearing since engaged. Since the learned counsel for the applicant did not inform him about the dismissal of the writ petition, he could not take proper steps.

This Court has also gone though the other contentions made in the instant application. According to this Court, there is no valid explanation regarding the cause of delay in preferring the application for restoration.
