HON'BLE MR. JUSTICE ARINDAM LODH O_r_d_e_r 18.12.2020 Heard Mr. D. C. Saha, learned counsel appearing for the claimant-applicants and Mr. P. Gautam, learned counsel appearing for the respondent-insurance company.

This is an application for withdrawal of the awarded amount which is lying in the bank under a Fixed Deposit Scheme (FDS for short). Having gone through the records, it is found that the certificate which was issued by the bank in favour of the claimant-applicants was for a period of 3(three) years which has been expired by this time. The awarded amount was deposited in a FD scheme with the UCO Bank on 27th May, 2016 and by this period, the certificate is matured. Since this Court had passed a direction to deposit the awarded amount in a FD scheme for three years without any further provision to continue this scheme, this Court is of the opinion that the money so deposited may be disbursed in favour of the claimant-applicants. Accordingly, Registry is directed to ensure the release of the total amount so deposited with the UCO Bank under a FD scheme within a period of 3(three) weeks from the date of this order.

With the aforesaid observation and direction, the instant interlocutory application stands allowed and disposed of. JUDGE A.Ghosh
