Guha, learned counsel appearing for the respondent-applicant, has fairly submitted that in view of the concurrent finding passed both by the trial court and the first appellate court, the possibility of the appellants succeeding in the appeal is bleak, but at the same time, she has acceded that, if the interim order of maintaining status quo is vacated, the appeal which has been admitted would be infructuous for all purposes and as such she has suggested that if the appeal is heard within a short time, she will not insist for vacation. Mr. A. Sengupta, learned counsel appearing for the appellants did not oppose such prayer. It appears that the suit is between the father and the son. Having regard to all aspects of the matter, this court is of the opinion that the connected appeal has to be heard as expeditiously as possible, without passing any effective order in this petition.
