This is a petition filed Order XII Rule 4 of the C.P.C. for substituting the legal heirs of the respondent No.2 namely, Makhan Ch. Biswas, who died on 23.05.2014 during pendency of CRP No.69 of 2013.

Mr. Laskar, learned counsel appearing for the respondents submits that the other remaining respondents do not have any opposition to such prayer. Accordingly, the legal heirs, whose name and description provided in the schedule appended to this petition be substituted in place of the respondent No.2 as the respondents No.2(a), 2(b) & 2(c) in the same manner as has been provided to the said schedule. Accordingly, this CM. Application stands allowed and disposed of. The petitioners shall furnish a corrected cause title in the Registry within 7(seven) days from today after supplying a copy thereof to the counsel for respondents and thereafter, the Registry shall correct the cause title of CRP No.69 of 2013.
