SAHA The instant writ petition is filed by the petitioner for setting aside/quashing the order of eviction dated 21.06.2008, affirmed by the appellate authority by order dated 04.11.2008 and also to grant relief available under Section 135(d) of the TLR & LR Act by declaring the petitioner No. 1 as Raiyat.

When the matter is taken up for hearing, Mr. Biswas, learned counsel appearing for the petitioners wants to withdraw the petition to approach the Civil Court and till then to continue the order of status quo passed by this Court on 16.01.2009. Also heard Mr. D. C. Nath, learned counsel appearing for the State respondents. In view of the submission of Mr. Biswas, the instant writ petition is disposed of with a liberty to the petitioners' to approach the Civil Court within a month and till then the status quo order granted by this Court earlier shall continue. It is made clear that after completion of one month, the respondents are at liberty to take any action, in accordance with law.
