From the record of the trial Court, I find that Manindra Ch. Deb was served by substituted service in the trial Court. He did not put in appearance and has not contested the case. It is also clear that he is also a defendant-respondent and his interest is similar to that of the petitioners. Therefore, I do not feel it necessary to serve the said petitioner.
