Deb Gupta, learned counsel, that respondent No.1 Smti. Bishu Kannya Debbarma has died. She was the mother of the deceased and any amount payable to her will be shared by all her legal heirs. However, her estate is duly represented and it is not necessary to issue notice to her legal heirs in this petition. Her name is, therefore, deleted from the array of the respondents. This is an application for condonation of delay of 172 days in preferring the appeal. The grounds given in the petition are not very satisfactory. However, keeping in view the larger interest of justice, the same is allowed and the delay in filing the appeal is condoned subject to payment of Rs.

2,000/- (rupees two thousand) as costs to be paid to the Tripura High Court Bar Association, Library Fund for purchase of books. Costs to be paid within four weeks from today. Thereafter, the appeal [MAC APP. 38 of 2014] be listed for admission on 11-0- -2015.

CM Application stands disposed of.
