This is a petition under Section 389 of the Cr.P.C. for suspending the sentence as imposed by the impugned judgment and order dated 31.03.2015 delivered in case No. S.T. 162 of 2012 by the Sessions Judge, West Tripura, Agartala. The sentence passed against the appellant is only restricted to a fine of Rs.40,000/- and in default of payment of fine, to suffer rigorous imprisonment of 9(nine) months. Having regard to the nature of the case and as an exception of the ordinary rule, this Court is of the considered opinion that the judgment and order dated 31.03.2015 delivered in case No. S.T. 162 of 2012 by the Sessions Judge, West Tripura, Agartala shall remain suspended till disposal of the appeal being CRL. A. No.11 of 2015. The appellant shall remain on bail as by virtue of the order, the default sentence might visit the appellant.
The trial court shall release the appellant on furnishing a bail bond of Rs.10,000/- (Rupees Ten thousand) supported by 1(one) surety of the like amount to the satisfaction of the Sessions Judge, West Tripura, Agartala. Accordingly, this petition stands allowed disposed of.
