Mr. Biswas while praying for re-admission of the RSA 35 of 2008, submits that on 29.04.2015 learned counsel for the applicant was busy in court No.1 for which he could not appear in the hearing of the aforesaid appeal. Considering the reasons for non-appearance of the learned counsel of the applicant, the order dated 29.04.2015 passed in RSA 35 of 2008 is hereby set aside and the appeal is readmitted in its original file.
