National Insurance Co. Ltd. v. Sabita Biswas And ORS
IA NO.01 of 2017 IN Mac App No.15 of 2009 (D/O) _B_E_F_O_R_E_ THE HON'BLE THE CHIEF JUSTICE MR T. VAIPHEI Present :
For the applicant : Mr. P. Chakraborty, Advocate. For the respondent : None.
30.06.2017 Heard Mr. P. Chakraborty, the learned counsel for the applicant. No representation from the respondent despite service of the copy of the application to the learned counsel.
This Court in its judgment and order dated 12-022015 in T.S.(Mac) No.276 of 2006, while disposing of the appeal, had directed that the interest accruing on the deposited amount should be remitted to the applicant every year by 1st July. Out of the deposited amount, `1,00,000/- has now been released in favour of the applicant. The deposited amount is kept in a Fixed Deposit with the UCO Bank, High Court Branch. The applicant desires that the yearly payment of interest should be converted into monthly payment so that she could utilize the money more beneficially.
I find force in the application of the applicant. The Senior Manager, UCO Bank, High Court Branch is, therefore, directed to release the interest in favour of the applicant in every two months instead of lump sum payment yearly to the applicant.
The application is disposed of.
