SAHA When the matter is taken up for hearing, learned counsel for the parties submits that the instant appeal is fully covered by the judgment of this court passed in a number of cases arising out of the same notification whereby and whereunder land in question in the instant appeal was also acquired. Out of these appeals, one of the appeals is L.A. 37 of 2008.

This court has gone through the judgment of the learned Single Judge passed in the aforesaid appeal No. 37 of 2008 along with other appeals on 1.12.2014. In those appeals, the learned Single Judge disposed of the appeals and cross-objections in the following manner:

"13. In view of the above discussion, the appeals and cross-objection are disposed of in the following manner.

(i) All the land owners shall be entitled to compensation for the value of the land @ Rs.1,00,000/- per kani irrespective of the classifications of the lands. (ii) That in case of non-fruit trees other than rubber trees the claimants shall only be entitled to the amount or value of these trees as assessed by the L.A. Collector. (iii) In case of rubber plantations and trees the land owners shall be entitled to Rs. 210/- per plant. (iv) The number of trees/rubber plants shall be determined by the executing court on the basis of the valuation report of rubber trees as assessed by the L. A. Collector and exhibited as Exbt. A series.

14. On the amount of compensation so assessed the claimants shall be entitled to additional compensation, solatium and interest as per the provisions of the L.A. Act." As the land in the instant appeal is involved relating to the same notification and the appeal is also covered by the judgment of the learned Single Judge as stated supra, the instant appeal is disposed of in terms of the order passed in the aforesaid appeal No. 37 of 2008 along with other appeals.
