PARTHA SARKAR Vs THE STATE OF TRIPURA HONBLE THE CHIEF JUSTICE DEEPAK GUPTA This application for grant of bail has been filed by the applicant Sri Ripan Sarkar on behalf of accused Sri Partha Sarkar in connection with a case arising out of FIR No.135 of 2014 registered with Bishalgarh Police Station under Sections 409/468/471/34 of the Indian Penal Code (IPC) and Section 13 of Prevention and Corruption Act, 1988. On merits of the case I see no reason to grant bail because the charges against the accused are serious in nature. The only reason which has weighed with this Court for grant of bail is that the wife of the accused is in advance stage of pregnancy and it is stated by Mr. D Bhattacharji that the delivery is expected at any time.

The wife and the unborn child of the accused have not committed any crime and they should not be deprived of his attention and love during this period. Therefore, only on this ground, I direct that the accused person namely Sri Partha Sarkar be released on interim bail for a period of three months on his furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with one surety of the like amount to the satisfaction of the trial Court subject to the following terms and conditions :

(i) That, the accused person is directed not to tamper with or in any manner influence the prosecution witnesses;

(ii) That, the accused shall ensure that no threat directly or indirectly is given to (iii) The accused is further directed not to cause any hindrance in the investigation; (iv) The accused shall not leave Tripura without permission of the appropriate Court; (v) The accused shall not try to meet any of the witnesses of the case nor any of the relatives of the co-accused Bimal Chakraborty. (vi) It is made clear that this bail has been granted only to attend upon his wife and children and the accused shall confine himself to his hospital and residence and not go anywhere else except for the medical needs of any. (vii) In the bail bond the accused shall also give an undertaking that he shall himself surrender at the Kendriya Sanshodanagar (Central Jail), Bishalgarh on 2nd July, 2015 by 11.00 a.m. latest.

(viii)In case, the accused violates any of the conditions or try to delay the trial, the prosecution shall be at liberty to approach this Court for cancellation of bail. The bail application is disposed of in the aforesaid terms. On the applicant filing application for supply of the copy on payment of appropriate fees, the copy of the same shall be supplied to the applicant by tomorrow.
