Chakraborty for the petitioners and learned P.P., Mr. A. Ghosh for the State-respondent are present. The report of the Probation Officer is received. Perused the report of the Probation Officer. There is nothing adverse reported by the Probation Officer against the accused-petitioners.
Heard learned counsel of both side.
In view of the report submitted by the Probation Officer and taking into consideration the nature, character, habit and antecedent of the accused-petitioners, they are allowed to go on probation on their execution of a bond of Rs.5000/-(rupees five thousand) only with one surety of like amount on condition to appear and receive sentence within a period of two years from today and in the meantime to maintain peace and to be of good behaviour. During the period of probation they shall not indulge in any criminal activities and they shall remain under the supervision of the Probation Officer, Kailashahar, Unakoti District and the Probation Officer shall submit report to the concerned Chief Judicial Magistrate as and when occasion so arise.
The bond of probation shall be submitted before the learned Chief Judicial Magistrate, Unakoti District, Kailashahar who shall accept it to his satisfaction. Send a copy of this order to the Court of learned Chief Judicial Magistrate, Unakoti District, Kailashahar.
Send back the L.C. records along with a copy of judgment dated 10.03.2015 and a copy of this order.
