The trial Court has fixed the case today for judgment and the first order which is challenged is of 18.02.2015. There is virtually no explanation why the order was not challenged earlier. The case was fixed by the learned trial Court for judgment today vide order dated 19th June, 2015. The copy of the order was applied on 22nd June, 2015 and was made available to the learned counsel on 24th June, 2015. The petitioner knew fully well that the case is fixed on 17th July, 2015 for pronouncement of the judgment but still the petition has been filed only on 14th July, 2015 and not earlier.

Therefore, on this ground alone I reject this petition. It is, however, made clear that since the petition has been rejected on this ground the petitioner shall be at liberty to raise all grounds raised in this petition in any appeal if the judgment is against the petitioner. Petition is disposed of.
