JUSTICE S.TALAPATRA By this petition filed under Section 152 of the C.P.C., the petitioners pray for correction of the typographical error crept in the cause title of the judgment dated 27.05.2015 delivered in R.S.A. No.80 of 2007 (D/O).
On scrutiny of the records, it appears that while typing the cause title, the name and description of the respondents No.2 & 3, namely, Reba Debbarma and Ivylata Debbarma, the petitioners herein, were not incorporated by inadvertence, possibly for the reason that the incorporation of their name was made on the reverse of the page-2 of the memorandum of appeal.
Mr. S. Bhattacharji, learned counsel appearing for the petitioners has submitted that this typographical error be corrected by incorporating the name and description of the petitioners in the cause title of the said judgment as the respondents No.2 & 3. Mr. P. Chakraborty, learned counsel appearing for the appellant-respondents did not raise any objection and he has submitted that such incorporation will not cause prejudice to none.
Having regard to the consensus, as well as on scrutiny of the records, this Court is of the view that in the cause title of the judgment dated 27.05.2015 delivered in R.S.A. No.80 of 2007 (D/O), the name and description of the petitioners, namely, Reba Debbarma and Ivylata Debbarma be incorporated as the respondents No.2 & 3 respectively. The Registry is directed to incorporate the name of the respondents No.2 & 3 in the cause title of the judgment dated 27.05.2015 delivered in R.S.A. No.80 of 2007 (D/O). Accordingly, this CM. application stands allowed and disposed of. This order shall form part of the judgment dated 27.05.2015 delivered in R.S.A. No.80 of 2007 (D/O).
