When the matter is taken up for hearing Mr. Chakraborty pointed out that the respondents No.1, Radha Raman Dutta and the respondent No.2, Smt. Sandhya Rani Datta, died on 14.01.2014 and 14.05.05 respectively leaving behind their legal heirs, namely, Sri Ashok Datta, Sri Kishore Datta, Sri Samir Datta, Sri Sankar Datta and Sri Samar Datta and the said information was also given to the appellant on 22.01.2015, but the appellant did not substitute the legal heirs of the respondents in the instant appeal and as a result, the appeal is abated. Ms. Sharma Lodh also accepted the contention of Mr. Chakraborty. In view of the above, it is not necessary for this court to decide the appeal on merit.
