This is a petition seeking re-admission of RSA No.78 of 2011 which was dismissed for non-prosecution on 22.06.2015.

Learned counsel, Mr. Roy Barman fairly submits that he has no objection if the appeal is admitted back in its original number and taken up for hearing and disposal on its own merit.

Considering the submission of learned counsel of both side, prayer for re-admission of the second appeal is allowed.

Registry is directed to re-admit RSA No.78 of 2011 in its original number and to list it for hearing on 15.10.2015.
