Heard learned counsel of both side.

Record shows that respondent No.3 did not turn up in spite of service of notice. It is submitted by learned counsel Ms. Dhar appearing for respondent Nos.1 and 2 that the Municipal authority has already constructed a multistoried building at Maharajganj Bazar without disturbing the shop premises of the petitioners. So there is no further cause of action for insisting the writ petition.

Learned counsel Mr. Biswas submits that since the building has already been constructed without disturbing the petitioners, the petitioners do not like to further insist the writ petition.

In the writ petition, the petitioners also prayed for allowing them to pay the arrear rent, etc. and learned counsel Mr. Biswas submits that the petitioners shall offer the arrear rent and since they have not been disturbed, the respondents will accept the arrear rent. The petitioners may offer the arrear rent in respect of the toujis in their names and, in case, such offer of arrear rent is made by the petitioners, the respondents shall take appropriate steps.
