Learned CGC, Mr. Majumder for the appellant-petitioner prays for allowing the substitution petition.

Mr. Dutta, learned counsel for the respondents submits that though there are some defects in the substitution petition itself but he does not like to raise the technical point at this stage and that he likes to see the appeal itself is disposed of at the earliest. In view of the submission of learned counsel of both side the prayer for substitution of the legal representatives of deceased respondent No.3 in the condonation petition, i.e. CM Application No.367 of 2013 is allowed.
