SAHA These applications have been filed with these five writ petitions by the State praying that it may be permitted to encash the bank guarantees and the fixed deposits furnished by the writ petitioner in terms of the stay orders granted by this Court. Learned counsel for the petitioner submits that he has no objection to the same and that the State may encash the fixed deposit receipts lying in the Registry. He, however, very fairly points out that as far as the bank guarantees are concerned those have expired in November, 2014 and therefore, the bank may not honour the bank guarantees. Therefore, a direction is given to the petitioner to either renew the bank guarantees within 4(four) weeks from today or pay the amount as payable under the bank guarantees on or before 30th April, 2015.

As far as the fixed deposit receipts are concerned, those are lying deposited with the Registrar General of this Court, who shall hand over the same to Mr. S. Chakraborty, learned Addl. GA and Mr. D.C. Nath, learned counsel for the State in respective cases so that they can be handed over to the department for encashment in terms of the orders of this Court.
