This is a petition under Section 389 of the Cr.P.C. for suspending the sentence as awarded by the impugned order dated 18.03.2015 delivered in Special (P.C.) 06 of 2013 by the Special Judge, West Tripura, Agartala.

In pursuance to the judgment of conviction, the appellant has been sentenced to suffer rigorous imprisonment for 3(three) years and to pay a fine of Rs.10,000/-, in default of payment of fine to suffer further rigorous imprisonment for 3(three) months. Having regard to the provisions of sub Section 3 of Section 389 of the Cr.P.C., this Court is of the considered opinion that the sentence of the appellant-applicant may be suspended till disposal of the connected appeal and accordingly, it is ordered. The appellant-petitioner may remain on bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty thousand) supported by 2(two) sureties of the like amount to the satisfaction of the trial court.

Mr. A. Ghosh, learned P.P. appearing for the State does not oppose the prayer as the petitioner did not misconduct himself while he was on bail. Having held so, this petition stands allowed and disposed of. A copy of this order be furnished to Mr. D.C. Roy, leaned counsel in the course of the day if the requisite application with fee is filed.
