JUSTICE S.TALAPATRA The instant application is filed by the convict appellant-petitioner for suspension of sentence dated 21.03.2015 passed by the learned Addl. Sessions Judge, West Tripura, in connection with Case No. S.T. 29/(WT/K) of 2013 wherein, the convict appellant-petitioner was convicted under Section 307 of the IPC and sentenced to suffer RI for 3(three) years with a fine of Rs. 500/- in default to suffer SI for 1 month. Heard Mr.D. C. Roy, learned counsel appearing for the appellant-petitioner and Mr. A. Ghosh, learned P.P. appearing for the State respondent. This Court has gone through the impugned judgment and after going through the impugned judgment, this Court is of the considered opinion that this is a fit case where the order of sentence dated 21.03.2015, passed by the learned Addl. Sessions Judge, West Tripura, should be suspended.

Accordingly, it is ordered that the order dated 21.03.2015 shall remain suspended till the disposal of the connected appeal being Crl. A(J). No. 62 of 2015 and the appellant-petitioner shall be released on bail on furnishing a bail bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the learned Trial Court.
