JUSTICE S.TALAPATRA The instant application is filed by the convict appellant-petitioner for suspension of sentence dated 07.10.2015 passed by the learned Sessions Judge, South Tripura, Belonia, in Case No. S.T. 58(ST/B) of 2013 wherein, the convict appellant-petitioner was convicted under Section 489-B and sentenced to suffer RI for 5 years and also to pay a fine of Rs. 5,000/,- and in default of payment of fine shall suffer further imprisonment for another 6 months and again the convict appellant was sentenced to suffer RI for 2 years and also to pay a fine of Rs. 3,000/- only in default of payment of fine shall suffer SI for further 3 months for the offence punishable under Section 489 C of IPC and both the sentences shall run concurrently.

Heard Mr. A. C. Bhowmik, learned counsel appearing for the appellant-petitioner and Mr. R. C. Debnath, learned Addl. P.P. appearing for the State respondent. This Court has gone through the impugned judgment and after going through the impugned judgment, this Court is of the considered opinion that this is a fit case where the order of sentence dated 07.10.2015, passed by the learned Sessions Judge, South Tripura, Belonia, should be suspended.

Accordingly, it is ordered that the order dated 07.10.2015 shall remain suspended till the disposal of the connected appeal being Crl. A(J). No. 63 of 2015 and the appellant-petitioner shall be released on bail on furnishing a bail bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the learned Trial Court. The I.A. is, accordingly, disposed of.
