JUSTICE S.TALAPATRA The instant application is filed for condoning the delay of 5 years 3 months 25 days in preferring the appeal against the judgment dated 25.05.2010 passed by the learned Sessions Judge, North Tripura, Kailashahar in case No. S.T. 04(NT/K) of 2010 wherein, the appellant-petitioner was convicted under Section 376(1) of IPC and sentenced to suffer 7 years RI and to pay a fine of Rs. 10,000/- and in default to suffer 6 months SI. Heard Mr. D. C. Roy, learned counsel appearing for the appellant-petitioner and Mr. A. Ghosh, learned P.P. appearing for the respondent State. We have gone through the reasons as explained in the petition and according to us the delay has been properly explained and the same is also satisfactory.
