SAHA Affidavit has been filed pursuant to our direction dated 11.06.2015 wherein the appellant has prayed that in terms of the letter of the Bank dated 12.05.2015 she is willing to settle the matter on the basis of onetime payment under the Special Settlement Scheme 2015. Learned counsel for the Bank states that he has no objection if the petitioner settle this matter under the said scheme. He, however, submits that the petitioner must meet all the conditions of the scheme. It is not for the Court to decide this issue. Since the parties are agreeable to settle the matter under the one time settlement scheme, the petitioner may approach the Bank and comply with the conditions/stipulations of the scheme and settle the matter outside the Court.

We therefore, dispose of the petition with the following directions: (i) That the petitioner shall approach the bank within one week from today and the Bank within one week thereafter shall clearly inform the petitioner in what manner the petitioner has to pay the amount.

(ii) If the petitioner does not settle the matter or does not pay the amount in terms of the settlement the Bank shall be free to take appropriate action in accordance with law. Download Date: 8-05-2017 15:05 1/1
