JUSTICE S.C.DAS The petitioner by means of this petition has sought for certain reliefs including deduction of subsidy amount and had also prayed that the bank be restrained from taking action against the petitioner under Section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act,2002. Now rejoinder has been filed and the petitioner, along with the rejoinder, has annexed two bank statements which have been issued by the respondent bank. The petitioner states that he accepts those statements to be correct. He prays that he may be permitted to withdraw the writ petition with liberty to him to approach the bank for one time settlement of his claims. This prayer is allowed. The writ petition is dismissed as withdrawn.

The petitioner is directed to submit representation to the bank for one time settlement of his claims within a period of one week from today. Thereafter the bank shall dispose of the same within three weeks of the receipt thereof. Till 15th September the bank shall not take any action under the SARFAESI Act,2002. In case a settlement is arrived at between the petitioner and the bank then the parties shall abide by that settlement and if no settlement is arrived at, the bank shall be free to proceed in accordance with law.
