JUSTICE S.TALAPATRA The instant application is filed by the convict-appellant-applicant for condoning the delay of four years and twenty days in preferring appeal against the judgment of conviction and sentence dated 19.05.2011 passed by the learned Sessions Judge, West Tripura, Agartala in case No. ST 16 of 2009 wherein the appellant has been convicted under Section 302 of the IPC and sentenced him to suffer RI for life and to pay a fine of Rs. 2,000/-, i.d. to suffer further SI for two months.

Heard the learned counsel for the parties.

We have gone through the reasons given by the convict-appellant-applicant for causing delay in preferring the appeal.

According to us, the delay has been properly explained and the same is satisfactory. Accordingly, the delay of four years and twenty days is hereby by condoned. Crl. M. Application is disposed of.
