Bhowmik, learned counsel appearing for the petitioner who has filed the written ejahar dated 15.06.2015 and based thereon, Kakraban P.S. Case No.201544B0154/2015 has been registered under Section 498-A/323/34 of the IPC on 21.06.2015, Annexure-A to this petition.
The grievance of the petitioner, in a nutshell, is that though she has disclosed specifically the commission of outraging her modesty and attempt to kill her, the police have not registered the case under the relevant provision of the penal code. On the part of a disclosure they have registered the case.
Mr. J. Debbarma, learned counsel appearing on instruction of Mr. A. Ghosh, learned Public Prosecutor, has submitted that the police is investigating the matter and if required the appropriate section/s would be added at the instance of the police and with leave of the court. He has further assured this court that the police is investigating bona fide. In view of the said statement and having regard to the phase of the investigation, this court is not inclined to interfere the investigation in any manner. But, it is expected that the police/ the Investigating Officer shall investigate the allegations as made in the written ejahar dated 15.06.2015 with right earnestness. If necessary, the police would act to add appropriate section/s to draw the investigation to its logical end. Accordingly, this petition stands dismissed.
However, if the petitioner feels aggrieved after the final police report, she may approach the competent court for the remedy and this dismissal will not be a bar for that purpose. Download Date: 8-05-2017 15:05 1/1
