SAHA The instant application is filed by the convict appellant-petitioner for suspension of sentence dated 29.07.2015 passed by the learned Sessions Judge, Udaipur, Gomati District in Case No. ST 09(GT/U) of 2015, wherein, the petitioner was convicted under Section 498(A) of the IPC and sentenced him to suffer RI for 2 years and to pay a fine of Rs. 10,000/-, in default to suffer further SI for two months. Heard Mr. B. Debnath, learned counsel appearing for the appellant petitioner and Mr. R. C. Debnath, learned Addl. P.P. appearing for the State respondent. This Court has gone through the impugned judgment, which is under challenge in Crl. App. No. 17 of 2015. According to this Court, this is a fit case where the sentence should be suspended.

Accordingly, the order of sentence dated 29.07.2015, passed by the learned Sessions Judge, Udaipur, Gomati District, in the aforesaid sessions trial, is suspended till the appeal is disposed of.

The appellant, the convict petitioner shall be enlarged on bail on furnishing a bail bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the learned Trial Court, i.e. the learned Sessions Judge, Udaipur, Gomati District.
