JUSTICE S.C.DAS This is a petition for review of the judgment. The main ground for review is that the judgment of the Gauhati High Court in Srish Chandra Choudhury Vrs. State of Tripura and Others : AIR 1987 Gauhati 24 states that its decision in respect of members of the Laskar community will be prospective in nature.

We are not at all in agreement with the averments made in the petition. The judgment of the Gauhati High Court emerged in the judgment of the Apex Court and members of the Laskar community cannot be held to be member of the Scheduled Tribe.
