SAHA The instant application is filed for condoning the delay of 289 days in preferring the appeal against the judgment dated 09.02.2012 passed by the learned Land Acquisition Judge, North Tripura, Kailasahar in Civil Misc. (LA) 6 of 2009. Mr. Majumder learned CGC submits that the respondent no.7 died in the year 2011 whereas the instant application was filed in the year 2013 where he was made a party. Mr. Dutta, learned counsel appearing for respondent nos. 1 to 6 submits that the appeal is filed against a dead person.

This Court is not going through the debate. It appears from the record that on 16.12.2014 the applicant was allowed time for taking necessary steps in terms of the order dated 28.11.2014 subject to payment of Rs. 1,000/- to the High Court Legal Services Committee of the High Court of Tripura and thereafter, on 24.02.2015 again on the prayer of the learned counsel of the applicant time was granted till today subject to payment of Rs. 1,000/- to the High Court Legal Services Committee but till date no step have been taken and no payment has been made, as ordered by this Court.It also appears that two substitution petitions have been filed and those petitions were withdrawn and thereafter no application was filed for substitution of the legal heirs of respondent no.7.
